Infant Sleep Coaching GDPR Privacy Policy And Terms

Dawn Grey Infant Sleep Consulting is committed to ensuring that your privacy is protected.
This Data Protection Policy will help you to better understand what personal information I store and why.
Explaining Terms:
“Personal Data” Means any information that is personal to you and that you or another person could be identified by.
“Processing” Means anything that is done with that data- such as accessing, disclosing, destroying or using the data in any way.
“GDPR” Means the General Data Protection Regulations (EU) 2016/679;
“Protected Data” Means personal data received from or on behalf of the client with the performance of my obligations under this policy.

What purposes do I use your personal data for?

I currently store the following personal information:
Your Phone number and Email Address for the purpose of our communication and with your explicit permission: for references to contact you in future, through promotional emails and blogs through the company website.
Your home address: I keep this on file so that I know how to get to your home when I am booked to visit or work in your home and also so I can recommend or put you in touch with any relevant local practitioners such as craniosacral therapists, IBCLCs or nutritionists.
Your child/children’s name and date of birth for the purposes of the terms and conditions laid out in our contract (if applicable) in relation the care of that child and also so that I can tailor recommendations for routines, sleep expectations or sleep coaching based on the age of your child.
Your Name: As it appears on your invoices. Invoices are stored for 7 years in accordance with HMRC guidelines.

 Your child’s birth and health history, sleep patterns, your family set up, details of daily routines, work hours, and other information relevant to being able to assess and advise on their sleep in a holistic manner, taking into account all aspects of both your child's and your family life.

I will never share your personal details with anyone else without your permission and without legitimate reason to do so. Information that is stored electronically is password protected at all times. Paper files are kept under lock and key and will be until they are destroyed after 7 years. I will not use your personal details for marketing purposes, sell them or use them in any way that is not its original purpose.

I am registered with the Information Commissioners Office (ICO) to hold and store your personal information and follow all guidelines to keep this safe.

What safeguards are in place?

I will comply with the eight data protection principles in the DPA which state that personal data must:
  • Be processed fairly and lawfully
  • Processed for limited purposes and in an appropriate way
  • Adequate, relevant and not excessive for purpose (d) Accurate
  • Not kept longer than necessary for purpose
  • Processed in line with individual’s rights
  • Secure
  • Not transferred to people or organisations situated in countries without adequate protection. (I do not send your personal data outside of the UK at any time)
Your personal data will only be processed to the extent that is necessary for the specific purposes notified to you.

What rights do you have?

  • You may request access to the Data I hold about you at any time. Please make this request in writing.
  • You may ask to have inaccurate data about you amended or deleted.
  •  You may raise a complaint with Dawn Grey Infant Sleep Consulting and seek support from the Information Commissioners Office (ICO) if you have any concerns over how I have handled your data. (l) You will be given notification in respect of high breaches of the law.
  • If you believe that any information I am holding about you is incorrect or incomplete, please email me at info@dawngreynewbornconsulting.co.uk and I will promptly correct any information found to be incorrect.

Third parties

I will not disclose your personal data to any third party without your consent unless I am satisfied that they are legally entitled to the data, I am required to do so by law or if you violate my terms of contract. Where I do disclose your personal data to a third party, I will have regard to the eight data protection principles. I will only transfer personal data if they agree to comply by those policies

Payment of Fees and Booking terms

Fees for services are as detailed on this website.
If you need a more bespoke and individualised option, please contact me to discuss.
Payment and agreement to these terms are required to secure your booking, until then, your booking remains provisional.
You may rebook further sessions/support with Dawn Grey Infant Sleep Consulting to provide any additional follow-up support as required, in addition to your original package. Further support sessions or service bookings are subject to the same terms and conditions as this original agreement.

Term/Termination

This agreement will terminate one month after the date of your consultation, daytime or overnight booking. Any continuing support packages may be purchased separately and will be subject to the same terms and conditions explained in this contract, thus extending the agreement length.

Changes/Cancellations

Any changes made to these Terms and Conditions must be made in writing and signed by all parties. You may cancel this agreement, in writing, for any reason. If any services are cancelled after payment has been made, refunds are limited to any unearned fees, less a £30 processing fee, up to one month before the scheduled booking. All deposits are non-refundable. All consultations are to be paid in full prior to commencement of the agreed consultation date. Between 2 weeks and one week prior to your booking, 50% of your payment would be refundable, minus a £30 administrative fee. Between 1 week and 48 hours prior to your booking, 25% of your payment would be refunded in the eventuality of sickness or extenuating circumstances.
In the case of cancellation- if you cancel your booking fewer than 48 hours before your scheduled consultation, daytime or overnight booking – except for the death or serious illness of a member of your immediate family – there will be no refund. If you need to reschedule, you must give notice at least 48 hours in advance. Every effort will be made to accommodate your request though this will be at the discretion and availability of Dawn Grey Infant Sleep Consulting.

Acts of God

If an ‘Act of God’, such as a fire, flood, earthquake, or other natural calamity causes you to need to cancel my services, Dawn Grey Infant Sleep Consulting will require payment only for the time actually already spent sleep coaching. This is only applicable to sleep coaching services within the client’s home.

 Disclaimer, Acknowledgement and Waiver of Liability

By entering into this agreement, you understand that your and your family’s use of the services, sleep plans, overnight support and workshops offered by Dawn Grey Infant Sleep Consulting are voluntary, and that any injuries, accidents, or other complications resulting from your participation are your responsibility and no liability of Dawn Grey Infant Sleep Coaching.
You acknowledge and agree that it is your responsibility to follow instructions for any service provided or advice given to you, to seek help from Dawn Grey Infant Sleep Coaching if you have any concerns or questions, and to seek medical advice should you have any concerns about your child’s health.

Health Concerns and Medical Conditions

Both parties (Dawn Grey Infant Sleep Consulting and yourselves) will work together on the understanding that my role will be that of a professional Sleep Coach (Consultant) and you agree that none of the advice that Dawn Grey Infant Sleep Consulting provides shall be considered medical advice, nor should it be relied upon by you as medical advice.
You understand that you should always seek the advice of your GP, Health Visitor or Midwife and should consult with any of these, or your child’s Paediatrician if they have one, if you have any healthcare related questions or concerns generally, before embarking on a new sleep program, or if you are concerned about any risks to your baby/child’s health or well-being that may result from your participation in Dawn Grey Infant Sleep Consulting’s services. If a medical issue appears or persists, do not disregard or delay seeking medical advice from your GP or other qualified healthcare provider.
You agree to disclose any medical condition to Dawn Grey Infant Sleep Consulting that you are aware of or suspect your child has. Failure to do so could affect your child’s health and wellbeing and may result in termination of the contract with Dawn Grey Infant Sleep Consulting without notice. No cancellation refund will be offered in such circumstances.
You agree to follow safe sleeping practices in line with SIDS recommendations. For further information on this and best practice to protect the safety of your child , please visit https:// www.lullabytrust.org.uk/safer-sleep-advice/.

Guarantees of Results

Results of your sleep coaching are entirely dependent on the commitment from you (and any other caregivers) to consistently follow your sleep plan or advice given to you by Dawn Grey Infant Sleep Consulting. There can be no full guarantee of positive results, as many things can impact sleep at various times, including but not limited to: reflux or food allergies, temporary illness, teething, inconsistent sleep environment, reinforcement of unwanted sleep associations, developmental changes, growth spurts, and neurological developments and differences including undiagnosed (or known) additional needs. However, the assessment process and Sleep Plan is comprehensive and tailored to your child's needs and family parenting styles. Following the advice given, unless there are underlying unidentified medical issues, you should see an improvement to your child's sleep patterns and habits if followed consistently.

Confidentiality

During the course of my work with you it is possible that I could become aware of sensitive information about your family, career or personal situation. It is understood that this information would remain completely CONFIDENTIAL at all times and never disclosed to anyone without written consent, or a court order. In a similar manner I expect my clients to retain confidentiality also and not to share, duplicate (except for personal use), or plagiarise any documents that I send to you, and to keep these for your family’s personal use only, and that of any caregivers.

Response Times

Dawn Grey Infant Sleep Consulting will endeavour to answer emails, social media messages, correspondence and phone calls within 24 hours maximum except for Sundays. During the support period, as part of your package, I will endeavour to respond to you within 6 hours, or as immediately as possible during the hours of 9am -7pm.
By booking an appointment with me or contracting my services in any way, either directly or through my booking system, you are giving your specific and explicit consent for Dawn Grey Infant Sleep Consulting or Dawn Grey Newborn Consulting to hold the personal data outlined above and for its use as laid out in this policy, and acknowledge that you have fully read and understand this document, and also agree to the terms and conditions above.
